Charged with Domestic Violence - 'Assault Occasioning Actual Bodily Harm'
Nora Sayed of our office came into the matter, reviewed the mini-DV brief and developed a strategy to assist the client in maintaining a clean criminal record. Ms Sayed negotiated with the Prosecution to have all sequences withdrawn based on major inconsistencies in the witnesses’ statements. Ms Sayed presented the Police with the possibility that the statements that had been provided by the complainants had been improperly translated as the dialect of Mongolian that the interpreter spoke was very different to the dialect spoken by the witnesses. The officer in charge conceded she was not aware that there were different dialects of Mongolian, that the process of obtaining the statement was a long and difficult one and that the statements had not been read back to the witnesses to confirm the accuracy of their contents. Given this issue and other deficiencies in the prosecution case identified by Ms Sayed, the Police ultimately agreed to withdraw all three sequences. The client consented to a final AVO order being made without any finding of wrongdoing which meant he was finally able to return home to his family.
