Successful Outcome for Common Assault (Domestic Violence Related)
Our solicitor, Nicholas Hardy-Clements, represented a young man at Downing Centre Local Court in relation to Common Assault (Domestic Violence Related) pursuant to Section 61 of the Crimes Act 1990.
The case involved a domestic argument between our client and his wife at their residence which got heated and resulted in our client pulling the victim’s hoodie and slapping the victim across the face.
Our solicitor advised our client to plead guilty on the first occasion and proceed straight to sentence. Subsequently, our client pleaded guilty to the Charge at the first available opportunity.
Submissions
At sentence hearing, Mr. Hardy-Clements, provided lengthy written submissions which sought a reduction in the penalty imposed by the Magistrate for various reasons, of which included our client’s excellent prospects of rehabilitation and otherwise good character. These submissions were supported by a significant amount subjective material.
Outcome Achieved – Non-conviction with 12months good behaviour
After considering all the material before the Court,the Magistrate proceeded to deal with the matter by way of non-conviction on the condition that our client be of good behaviour for a period of 12 months .
This is a fantastic outcome of which exhibits the value of remarkable representation for an offence of which was domestic violence in nature.
