What is a ‘surety’ and how much money do I need?

The money is not ‘paid’ unless bail is breached; often, the court just needs proof the person has access to the funds.

What happens if bail is refused in the Local Court?

If bail is refused by a Magistrate in the Local Court, you generally have two options. 1) You can make a new application in the Local Court only if there has been a significant ‘change in circumstances’ since the refusal. 2) You can make one application to the Supreme Court of NSW. This is a complex, formal application that requires a senior lawyer and should not be attempted without specialist preparation.

Can I get bail on a weekend or public holiday in Sydney?

Yes. The NSW legal system operates a dedicated Bail Court that sits on weekends and public holidays, primarily at the Parramatta Local Court.
