Case
The 19-year-old mother had recently separated from her 19-year-old partner, with whom she has a 2-year-old daughter. The father took the child to spend time with him; however, he did not return the child to the mother’s care.
After contacting our office, the mother urgently requested to speak with a solicitor due to serious concerns for the child’s welfare, given the father’s previous criminal activity and involvement.
Our firm acted swiftly to prepare the court documents and filed them in the Federal Circuit and Family Court of Australia. At that time, a recovery order was issued by the Senior Judicial Registrar.
Result
Considering the history of family violence during the relationship, the Judicial Registrar ordered that the child be recovered by police and that the child was not to spend time with the father on an interim basis.
