Licence Suspension Due to Demerit Points | Jameson Law

Our Solicitor Wissam Philopos represented our client at Parramatta Local Court on 9 March 2023 in relation to the clients License Suspension Appeal pursuant to the Road Transport Act 2013 (NSW) in relation to the following charges:

  1. Exceed speed limit by no more than 10 km/h whilst driving a motor vehicle (Camera Detected).
  2. Exceed speed limit by no more than 10 km/h whilst driving a motor vehicle (Camera Detected).
  3.  Exceed speed limit by more than 10 km/h but not more ten 20 km/h whilst driving a motor vehicle (Camera Detected).

In short, our client was driving on an international driving licence for over 5 years and got his permanent residency in December. He failed his NSW driving test in January 2023 due to which he got a learner’s license. Soon after, the client discovered that his NSW Driver’s License was to be suspended because of six active demerit points to the three camera related speeding offences incurred between 2020 to 2022 while he was driving on his foreign license. Subsequently, the client received a letter from Transport for NSW advising that his NSW Driver licence will be suspended commencing 24 February 2023 for a period of three (3) months.

Submissions

In accordance with the clients’ instructions, our solicitor Mr Philopos proceeded to give oral submissions in support of the appeal. Mr Philopos tendered the following:

  1.  An apology letter written by the client;
  2.  A Character reference of the client;
  3. A letter from the client’s employer showing the need for the client to have his licence; and
  4. Certificate of completion of the Traffic Offenders Intervention Program.

Outcome Achieved-Appeal allowed.

Subsequently, Her Honour found the client is a fit and proper person to hold a NSW Driver licence and allowed the appeal against the decision of transport for NSW to disqualify the clients licence.
